Terms & Conditions

Last updated: 17 October 2026

1. Introduction

These Terms & Conditions ("Terms") govern your use of TradeMark Watch, a UK trade mark journal monitoring and conflict detection platform operated by Highland Coders Limited ("we", "us", "our"). By accessing or using the service, you agree to be bound by these Terms.

2. Definitions

  • "Service" means the TradeMark Watch platform and all related features.
  • "User" means any individual or organisation that registers for or uses the Service.
  • "UK IPO" means the United Kingdom Intellectual Property Office.

3. Eligibility & Accounts

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Subscriptions & Payment

The Service is offered as paid subscription plans (Solo and Agency tiers). Subscription fees are billed on a recurring basis through our payment provider. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are at our discretion unless required by law.

Lifetime offers: Lifetime Solo offers are paid for by a single, non-recurring payment. Lifetime-offer purchases are non-refundable for change of mind, except where cancellation or a refund is required by law. Nothing in these Terms excludes or limits your statutory rights, including any applicable cancellation rights or remedies where the Service is not supplied as required by law. This policy applies to purchases made under these terms and does not retrospectively remove rights under an earlier purchase.

5. Nature of the Service

TradeMark Watch monitors the UK IPO trade marks journal and highlights potentially relevant or conflicting marks based on your business profile and keywords. The Service is a research and monitoring tool only. It does not:

  • Constitute legal advice or a formal trade mark clearance opinion.
  • Guarantee that a trade mark is available, registrable, or safe to use.
  • Replace the services of a qualified trade mark professional.
  • Guarantee that every relevant or conflicting mark will be detected.

You should consult a qualified trade mark professional for formal clearance and filing decisions.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Misuse, reverse-engineer, or attempt to disrupt the platform.
  • Share your account credentials beyond your organisation's authorised users.
  • Use automated access to bypass access controls, disrupt the Service, or infringe the rights of others.

7. Intellectual Property and Public Data

Our software, design and original analysis are the intellectual property of Highland Coders Limited. This ownership does not extend to the underlying UK IPO journal data or to third-party trade marks. Your business profile data remains yours.

Applicable source copyright and database-right notices continue to apply. These Terms, including the acceptable-use restrictions, govern access to our Service and do not restrict your independent rights to reuse information under that licence.

The OGL does not cover personal data, third-party rights, or trade mark rights. Any use of those materials must have a separate lawful basis or permission where required. Displaying a trade mark for research does not grant a right to use it as your own.

Source information is supplied without a guarantee of accuracy, completeness or continued availability. Our monitoring results and risk assessments are our own analysis. See Data sources and licensing for details.

8. Limitation of Liability

To the maximum extent permitted by law, Highland Coders Limited shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including any failure to detect a conflicting or relevant trade mark. The Service is provided "as is" without warranties of any kind.

9. Termination

We may suspend or terminate your access to the Service if you breach these Terms or if your account remains inactive. Upon termination, your right to use the Service ceases immediately.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Scotland.

12. Contact

If you have questions about these Terms, please contact Highland Coders Limited through the details provided on our website.
